These Terms of Service ("Terms") govern your access to and use of MapState Inc.'s services, software, and website (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old and have the authority to bind the organization (if applicable) to these Terms. By signing up, you represent that these conditions are met.
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at security@mapstate.com if you suspect unauthorized access.
Each workspace is associated with one organization. You may not resell or sublicense access to the Service without our written consent.
You agree not to:
You retain full ownership of all property data, listings, and content you import into MapState. By using the Service, you grant MapState a limited, non-exclusive license to store, process, and display your data solely to operate the Service for you.
MapState does not acquire any rights to your data beyond what is necessary to deliver the Service.
We aim for 99.5% monthly uptime, excluding scheduled maintenance. Scheduled maintenance is notified at least 48 hours in advance via the dashboard and email. We are not liable for downtime caused by third-party infrastructure providers (AWS, Mapbox).
Plans are billed monthly or annually in advance. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
Accounts with unpaid invoices may be suspended after 14 days. Data is retained for 30 days after suspension to allow reactivation.
MapState and its logo are trademarks of MapState Inc. The platform, infrastructure, algorithms, and documentation are the intellectual property of MapState Inc. You may not use our trademarks without written permission.
To the maximum extent permitted by law, MapState's total liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to MapState in the 12 months preceding the claim.
MapState is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or goodwill.
You agree to indemnify and hold MapState harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
You may terminate your account at any time from Settings. We may terminate or suspend your account for violation of these Terms with reasonable notice, or immediately for severe violations (fraud, abuse).
Upon termination, your data is deleted within 30 days. Sections 4, 7, 8, and 9 survive termination.
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France, unless mandatory local consumer protection laws apply.
We may modify these Terms at any time. Material changes will be communicated by email at least 14 days before taking effect. If you do not agree with the updated Terms, you may terminate your account before the effective date.
